1. Introduction

Welcome to MKT Sharks. By accessing or using our platform, you (“you”, “user”) agree to comply with and be bound by these Terms & Conditions (“Terms”). These Terms apply to all users of our services including:

  • “Sharks” (subscribed members),

  • Property owners/clients whose properties we list,

  • Visitors browsing our platform without subscribing.

2. Definitions

  • Shark(s): individuals or entities who have subscribed to a Shark Plan and thereby gain access to the exclusive features and services of MKT Sharks.

  • Property Owners/Clients: individuals or entities who engage with MKT Sharks to have their properties listed on our platform. They do not themselves upload listings—MKT Sharks handles the listing based on verified information.

  • Visitors: persons who browse the platform but are not subscribed or listing properties.

  • Platform / Services: the website, interfaces, tools, and services provided by MKT Sharks for Sharks, property owners, and visitors.

3. Eligibility

  • Users must be at least 18 years old and legally capable of entering into contracts under Pakistani law.

  • By subscribing or otherwise using the platform you represent and warrant that you meet these eligibility criteria.

4. User Responsibilities

4.1 Accurate Information

  • You must provide accurate, complete and up-to-date information about yourself (in the case of Sharks) or about your property (in the case of property owners).

  • Misrepresentation, omission or falsification of information may result in suspension or termination of your access, and forfeiture of any rights under your subscription.

4.2 Compliance with Laws

  • You agree to comply with all relevant laws, regulations, and industry norms in Pakistan in your use of the platform and services.

4.3 Prohibited Activities

You are prohibited from:

  • engaging in fraudulent, deceptive or abusive behaviour;

  • submitting false or misleading property details;

  • uploading or transmitting harmful code, malware or viruses;

  • infringing intellectual property rights of others;

  • impersonating another person or entity;

  • using the platform in any way contrary to these Terms or as prohibited by law.

5. Property Listings

  • Property Owners/Clients engage MKT Sharks to list their property. They do not directly upload listings on the platform. MKT Sharks performs listing based on verified information provided.

  • Property Owners/Clients must have full legal rights and authority to list the property. They warrant that the information provided is accurate, lawful, and that no third-party rights are infringed.

  • MKT Sharks does not guarantee the accuracy or completeness of listings, and is not liable for any dispute arising between buyers and sellers regarding the property.

  • Sharks may promote or engage with listed properties as permitted under their subscription plan and any commission arrangements in place.

6. Subscription Plans & Payments

6.1 Shark Plan

  • Details (features, duration, price) of available subscription plans are provided on our website.

  • Payments must be made in Pakistani Rupees (PKR) and according to the payment methods available.

6.2 Refunds and Cancellations

  • Subscriptions are non-refundable. Once payment is processed, no refund will be granted.

  • You may cancel your subscription at any time; however, cancellation will not entitle you to a refund of any paid period.

6.3 Suspension for Non-Payment

  • If payment is not received when due, MKT Sharks reserves the right to suspend or terminate your access until payment is cleared.

7. Appointment Bookings

  • Sharks may book appointments with clients or property owners as permitted by their plan.

  • Submission of fake or fraudulent appointment bookings is strictly prohibited. If a user submits 5 or more fake appointments within a calendar month, MKT Sharks reserves the right to suspend or terminate the user.

  • MKT Sharks does not guarantee that all booked appointments will result in successful deals, and is not responsible for outcomes of such interactions.

8. Intellectual Property & Content

  • All content on the platform (including listings, text, graphics, logos, software) is owned by or licensed to MKT Sharks, unless otherwise specified.

  • You may not reproduce, distribute, modify, create derivative works of, publicly display or exploit any content from the platform without prior written permission from MKT Sharks.

  • If you submit content (e.g., profile photo, property details) you grant MKT Sharks a worldwide, non-exclusive, royalty-free license to use, host, display, transmit and distribute such content in connection with the platform.

9. Disclaimer of Liability

  • MKT Sharks acts as a facilitator of connections between Sharks, property owners and visitors. We do not directly manage or guarantee property transactions, legal compliance of listings, buyer-seller agreements or deal outcomes.

  • To the fullest extent permitted by law, MKT Sharks disclaims all warranties, whether express or implied, including but not limited to the accuracy, reliability, suitability or fitness for purpose of the platform or listings.

  • MKT Sharks will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, or anticipated savings arising out of or relating to your use of the platform, even if advised of the possibility of such damages.

  • MKT Sharks’ maximum aggregate liability shall not exceed the total amount you paid to MKT Sharks for your subscription plan in the preceding twelve-month period.

10. Termination & Suspension

  • MKT Sharks reserves the right to suspend or terminate your access (in whole or in part) if you breach these Terms, engage in fraudulent or abusive conduct, or otherwise act in ways detrimental to the platform, other users or MKT Sharks itself.

  • Upon termination, you will not be entitled to any refund. Your data may be retained or deleted in accordance with our Privacy Policy.

  • The provisions of these Terms which by their nature should survive termination (e.g., disclaimers, intellectual property, liability limitations) will continue to apply.

11. Modifications to Terms

  • MKT Sharks may modify or update these Terms at any time. The revised Terms will take effect when posted on our website with the updated effective date.

  • Your continued use of the platform after such changes constitutes your agreement to the updated Terms. We recommend you review them regularly.

12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the Islamic Republic of Pakistan.

  • Any dispute arising out of or relating to these Terms or the platform shall be resolved through Pakistan’s courts, and you submit to the exclusive jurisdiction of such courts.

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13. Force Majeure

  • Neither party shall be liable for any delay or failure in performance due to events beyond its reasonable control (e.g., acts of God, governmental regulations, internet failures, war, civil disturbance).

  • The affected party must notify the other as soon as reasonably practicable and take reasonable steps to resume performance when feasible.

14. Entire Agreement

  • These Terms (together with our Privacy Policy and any other policies referenced) constitute the entire agreement between you and MKT Sharks regarding your use of the platform, and supersede all prior or contemporaneous understandings or agreements.
